General Terms and Conditions For The Sale of Precious Threads by Abiola Products
Welcome to our online store.
It is understood by the Customer that by placing an order on the Precious Threads by Abiola website, the Customer fully and unreservedly acknowledges and accepts the below terms and conditions.
Product Orders
The Customer must provide Precious Threads by Abiola with a valid e-mail address to which required information (information under these General Terms and Conditions of Sale) and any other information concerning the order will be sent. From time to time, Precious Threads by Abiola may modify, remove (temporarily or permanently) some of the products and/or services, related features and specifications that are displayed on or made available through the website. In addition, Precious Threads by Abiola may make changes to the applicable prices for the aforementioned products and/or services. Precious Threads by Abiola may limit or cancel quantities purchased per person, household or order. These modifications and removals will apply immediately and to all future purchases of products and services.
Precious Threads by Abiola reserves the right to not accept orders which are incomplete, incorrect or if products are unavailable. If Precious Threads by Abiola exercises such right, Precious Threads by Abiola will inform the Customer of said exercised rights and provide the reasons for doing so.
The Customer's shopping cart and the order summary sent to the Customer following completion of the purchase will include a description of the product(s) ordered, including measurements and/or sizes (where applicable) and the pricing information and associated costs (e.g. shipping costs).
Although Precious Threads by Abiola takes all reasonable measures to ensure the photographs on the website are a true reflection of the original product(s) in order to reduce inaccuracies as much as possible, certain variations are possible due to the Customer's computer's technical characteristics and colour resolution. In addition and in the case of products made from print fabric, variations will exist based on the pattern placement of each piece. As a result, each piece though made of the fabric shown on the website, will be unique in where the pattern/fabric is cut. Consequently, Precious Threads by Abiola will not be held responsible for any inaccuracies in the graphic representation displayed on the website or final print placement of the constructed Precious Threads by Abiola product(s). In addition, Precious Threads by Abiola reserves the right to correct any errors, inaccuracies and/or omissions and to change/update information including the cancellation of orders if the information on the site is inaccurate at any time and without prior notice (including after the submission of the order).
The Customer must click on the shopping cart/bag icon to view the selected product(s) and price of the product(s). The Customer must verify the content of the shopping cart/bag before completing the purchase form in accordance with the instructions provided on the website.
Product Prices
Product(s) prices do not include standard shipping costs, unless otherwise stipulated on the website or on the order page. The price of each product(s) is displayed for the Customer prior to the completion of the order. Before the Customer finalizes their order, Precious Threads by Abiola will itemize all associated costs on the order form with respect to the product(s) being purchased, including (i) shipping costs, (ii) applicable taxes and (iii) any possible additional charges payable to a third party of which it is aware and which can be reasonably estimated. All prices noted are in Canadian dollars.
Taxes
Where required, taxes may be applied to shipping and handling charges. Sales taxes will be refunded for any item returned (see Returns and Refunds for conditions), however the Customer will not be refunded sales taxes applied to shipping and handling charges as said charges are non-refundable once the item has been shipped.
Conditions of Payment
The Customer must make payment via one of the methods indicated on the order form.
For payment via credit card, the Customer is required to confirm on the website that he/she is the card holder and that the name indicated on the card is his/hers. The Customer must provide the credit card number, expiry date and CVV security code indicated on the card.
Completing the Order
The purchase is considered complete once the Customer confirms their order. It is expressly understood by the Customer that the order is binding once confirmation of the successful completion of the order is sent by e-mail to the address indicated by the Customer during the order process. Such confirmation includes the date of purchase, the product(s) ordered and the total purchase price.
Returns and Refunds
The Customer's right of return must be exercised as described below:
The right of return must be exercised by the Customer within 14 (fourteen) days of the date of shipping to the Customer or a third party on his/her behalf. To exercise the right of return, the Customer must contact Customer Care Services.
In order for the return to be processed, the Customer must adhere to the following:
The product(s) were not a custom order product (meaning, the product(s) were not made to the Customer's specific measurements, as in this case the product(s) are non-refundable/returnable)
The product(s) must be accompanied by the original invoice/receipt made available by Precious Threads by Abiola
The product(s) must be returned in their original packaging (box, accessories, inserts, protection, leaflets, etc.)
The product(s) returned by the Customer must not have been altered, damaged, used, worn or washed
Labels and security tags must still be attached to the product(s)
Precious Threads by Abiola reserves the exclusive right to refuse the return of any product(s) that have been altered, damaged, are incomplete, deteriorated and/or soiled in any condition clearly indicating the products have been used. Similarly, Precious Threads by Abiola will refuse any product(s) returned after the deadline indicated above, or lacking the original invoice/receipt. Precious Threads by Abiola also reserves the right to demand compensation (not exceeding the full price of the product(s)) for any damage caused by the Customer's negligent conduct or misconduct when returning the product(s). Precious Threads by Abiola cannot be held liable for lost or stolen product(s) beyond its control, or for returns to the wrong address or for delivery delays of any returned product(s) beyond its control. It is understood that the Customer assumes all risks of returns.
In the event of a product(s) being accepted for return, the Customer will be refunded all payments made to Precious Threads by Abiola for the returned product(s) in the same method of payment chosen at the time of purchase (including shipping costs, however minus any taxes applied to the cost of shipping). Refunds will be processed within 5 to 10 business days of receiving the return. Processing times may take longer depending on the card issuer.
Precious Threads by Abiola will refund these amounts upon acceptance and after inspection by Precious Threads by Abiola of the returned product(s).
